Terms of Service

Agreement

These terms are an agreement between you and ImageEnhance ("we", "us"), the service operated at imageenhance.app from the Hong Kong SAR. By using the service you accept them. If you do not, please do not use it.

What the service does

ImageEnhance runs AI models on photos you upload: upscaling, denoising, sharpening, restoring old photographs, removing scratches, colourising black and white images, removing backgrounds, sharpening text, and converting file formats.

Each tool sends your image to a third-party AI provider, which runs the model and returns a result. The Privacy Policy lists exactly which providers receive what.

Your account

You need an account for most tools; a limited free allowance works without one. You are responsible for what happens under your account, so keep your credentials to yourself and tell us if you think someone else has them. One person, one account — do not share logins or create extra accounts to collect the free allowance repeatedly.

Credits

The service runs on credits. Every tool has a fixed price in credits, shown on the button before you run it.

Where credits come from, and when they expire:

Spending order. Credits are spent oldest-expiry-first, so free and subscription credits are always used before permanent ones. This is deliberate: it wastes the least.

Failed runs cost nothing. If a run fails, the credits return to your balance automatically — see Refunds.

Credits are not money. They have no cash value outside the service, cannot be transferred or sold, and are not a stored-value instrument. Refunds are governed by Refunds below, not by your credit balance.

We may change credit prices for tools, and will announce a change before it takes effect. A change never retroactively drains credits you already hold.

Subscriptions

Subscriptions renew monthly on the date you subscribed, charged to your payment method until cancelled. You can cancel at any time in your account settings; cancelling ends the next renewal and you keep your credits until the current period ends. There is no cancellation fee and no need to talk to anyone.

Refunds

If the product did not do what you paid for, tell us and we will make it right. We would rather be specific than hide behind "at our sole discretion", so here is exactly when a refund applies.

Failed runs are always free. If a job fails — the model errors out, the provider times out, or nothing usable comes back — the credits return to your balance automatically, in software, whether or not you notice. You do not need to contact us.

Subscriptions. If you subscribe for the first time and it is not what you expected, email us within 7 days of the charge for a full refund, provided you have spent no more than 50 credits of that month's allowance. A renewal charge is refundable in full within 7 days if you have not spent any of that renewal's credits. Duplicate or unrecognised charges are always refunded in full, with no time limit.

Credit packs. Unused packs are refunded in full within 14 days of purchase. If you have spent some of a pack, we refund the unused portion pro rata within 14 days, provided at least 80% of it is unspent.

What we cannot refund. Credits already spent on successful runs — every run costs real GPU time the moment you press the button. Nor dissatisfaction with AI output quality: enhancement and restoration are judgement calls, not exact operations, which is why the free allowance exists so you can test every tool on your own photos before paying anything.

When our side is at fault, none of those windows apply. If the service was broken, mischarged you, or lost your work, we refund you regardless of elapsed time or credits spent. Time limits exist to stop the policy being used as free rental, not to protect us from our own mistakes.

How to ask. Email support@imageenhance.app from the address on your account and tell us what you bought and what went wrong. One or two sentences is enough; we do not require a form. We reply within 2 business days. Approved refunds go back through the original payment method and take 5–10 business days to appear, depending on your bank. We charge no processing fee.

Before a chargeback, please email us. We can almost always resolve it faster than a bank dispute, which freezes the payment for weeks. We will not punish you for filing one — we would just rather fix the problem directly.

Nothing here removes rights you have by law. Where mandatory consumer withdrawal or refund rights apply, they apply in addition to this section, and where they conflict, they win.

Your content

Your photos remain yours. We claim no ownership over anything you upload. We do not use your images to train AI models, and we do not license them to anyone.

We need your permission to do one narrow thing: transmit and process your image to produce the result you asked for, and store that result so it stays in your library. That permission ends when you delete the result.

You must have the right to upload what you upload. Do not upload photos you have no rights to, or images of people who have not agreed to it where their agreement is needed.

What you may not do

Do not use ImageEnhance to:

• Process sexual imagery of minors, or any content that sexualises children. This is the one line where we act without warning: we terminate the account and report it.
• Create deceptive imagery of real people — deepfakes, fabricated evidence, or anything intended to make someone appear to have done or said something they did not.
• Process images that are illegal to possess or distribute where you are.
• Break, overload, or circumvent the service — including automating the free allowance, evading quota limits, or scraping.
• Resell raw access to the models through us as an undisclosed intermediary.

If you break these rules we may suspend or close your account. Except for the first item, we will normally warn you first, and if we close a paid account for a reason that is not your fault we refund the unused remainder.

Results

The result is yours. You can use the images ImageEnhance produces for anything you like, including commercial work. We claim no rights in them.

Two honest caveats. First, AI output is not deterministic and cannot be guaranteed to look a particular way — that is why the free allowance exists, so you can test the tools on your own photos before paying. Second, in the United States and some other jurisdictions, purely AI-generated material may not qualify for copyright protection; that is a matter of law, not something we control, and we cannot promise you exclusive rights in a generated image.

Availability

We aim to keep the service running, but we do not promise uninterrupted availability. The models we depend on are run by third parties and can be slow, queued, or temporarily unavailable. We may change or discontinue features; if we discontinue something you are paying for, we will tell you and refund the unused remainder.

Liability

The service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses — lost profits, lost data, or lost opportunity.

Where liability cannot be excluded, our total liability to you is limited to what you paid us in the 12 months before the claim arose.

Nothing here limits liability that cannot legally be limited, including for fraud or personal injury, and none of it removes mandatory consumer rights you hold under your local law.

Changes to these terms

We may update these terms. If a change materially affects you, we will update the date above and notify signed-in users by email before it takes effect. Continuing to use the service afterwards means you accept the new terms.

Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region, where the service is operated. If you are a consumer, this does not deprive you of the protection of mandatory law in your country of residence.
